1. Contractual Relationship

 

These Terms of Use (Terms) govern the access or use by you, an individual, of applications, websites, content, products, and services (the Services) made available by MSVS Gig Economy Services Limited (Gigzeu) a private limited liability company established in India , having its registered office at C 573 Saraswati Vihar Delhi 110034 along with office in other states. PLEASE READ THESE TERMS CAREFULLY BEFORE ACCESSING OR USING THE SERVICES. Your access and use of the Services constitute your agreement to be bound by these Terms, which establishes a contractual relationship between you and Gigzeu. If you do not agree to these Terms, you may not access or use the Services. These Terms expressly supersede prior agreements or arrangements with you. Gigzeu may immediately terminate these Terms or any Services with respect to you, or generally cease offering or deny access to the Services or any portion thereof, at any time for any reason. Supplemental terms may apply to certain Services, such as policies for a particular event, activity or promotion, and such supplemental terms will be disclosed to you in connection with the applicable Services. Supplemental terms are in addition to, and shall be deemed a part of, the Terms for the purposes of the applicable Services. Supplemental terms shall prevail over these Terms in the event of a conflict with respect to the applicable Services. Gigzeu may amend the Terms related to the Services from time to time. Amendments will be effective upon Gigzeus posting of such updated Terms at this location or the amended policies or supplemental terms on the applicable Service. Your continued access or use of the Services after such posting constitutes your consent to be bound by the Terms, as amended. Our collection and use of personal information in connection with the Services is as provided in Gigzeus Privacy Policy located at http://gigzeu.com/privacy-policy.html. Gigzeu may provide to a claims processor or an insurer any necessary information (including your contact information) if there is a complaint, dispute or conflict, which may include an accident, involving you and a Third Party Provider (including any network company of Skill holder) and such information or data is necessary to resolve the complaint, dispute or conflict.

 

 

 

2. The Services

 

The Services constitute a technology platform that enables users of Gigzeus mobile applications or websites provided as part of the Services (each, an Application) to provide the database of Skill Holders for gig economy services under an agreement with Gigzeu. Unless otherwise agreed by Gigzeu in a separate written agreement with you, the Services are made available solely for your personal, non-commercial use. YOU ACKNOWLEDGE THAT GIGZEU DOES NOT PROVIDE Any kind of Skill SERVICES mentioned in category OR FUNCTION AS A those skill services carriers AND THAT ALL SUCH Skill SERVICES ARE PROVIDED BY Skill Holders WHO ARE NOT EMPLOYED BY GIGZEU OR ANY OF ITS AFFILIATES.

 

LICENSE.

 

Subject to your compliance with these Terms, Gigzeu grants you a limited, non-exclusive, non-sublicensable, revocable, non-transferable license to: (i) access and use the Applications on your personal device solely in connection with your use of the Services; and (ii) access and use any content, information and related materials that may be made available through the Services, in each case solely for your personal, non-commercial use. Any rights not expressly granted herein are reserved by Gigzeu.

 

RESTRICTIONS.

 

You may not: (i) remove any copyright, trademark or other proprietary notices from any portion of the Services; (ii) reproduce, modify, prepare derivative works based upon, distribute, license, lease, sell, resell, transfer, publicly display, publicly perform, transmit, stream, broadcast or otherwise exploit the Services except as expressly permitted by Gigzeu; (iii) decompile, reverse engineer or disassemble the Services except as may be permitted by applicable law; (iv) link to, mirror or frame any portion of the Services; (v) cause or launch any programs or scripts for the purpose of scraping, indexing, surveying, or otherwise data mining any portion of the Services or unduly burdening or hindering the operation and/or functionality of any aspect of the Services; or (vi) attempt to gain unauthorized access to or impair any aspect of the Services or its related systems or networks.

 

PROVISION OF THE SERVICES.

 

You acknowledge that portions of the Services may be made available under Gigzeus various brands or request options associated with database of skill holders, You also acknowledge that the Services may be made available under such brands or request options by or in connection with: (i) certain of Gigzeus subsidiaries and affiliates; or (ii) Skill Holders.

 

THIRD PARTY SERVICES AND CONTENT.

 

Gigzeu may proivde the user infromation to the third party service provider to work on behalf of or the company to provide users with the necessary assitance to help the company communicate with the users or to maintain the application. Gigzeu would be making calls & sending SMS to you thourgh Third Party platform for better services. The Services may be made available or accessed in connection with third party services and content (including advertising) that Gigzeu does not control. You acknowledge that different terms of use and privacy policies may apply to your use of such third-party services and content. Gigzeu does not endorse such third party services and content and in no event shall Gigzeu be responsible or liable for any products or services of such third party providers. 

 

3. Your Use of the Services

 

USER ACCOUNTS.

 

In order to use most aspects of the Services, you must register for and maintain an active personal user Services account (Account). You must be at least 18 years of age, or the age of legal majority in your jurisdiction (if different than 18), to obtain an Account. Account registration requires you to submit to Gigzeu certain personal information, such as your name, address, mobile phone number and age, as well as at least one valid payment method (either a credit card or accepted payment partner). You agree to maintain accurate, complete, and up-to-date information in your Account. Your failure to maintain accurate, complete, and up-to-date Account information, including having an invalid or expired payment method on file, may result in your inability to access and use the Services or Gigzeus termination of these Terms with you. You are responsible for all activity that occurs under your Account, and you agree to maintain the security and secrecy of your Account username and password at all times. Unless otherwise permitted by Gigzeu in writing, you may only possess one Account.

 

USER REQUIREMENTS AND CONDUCT.

 

The Service is not available for use by persons under the age of 18. You may not authorize third parties to use your Account, and you may not allow persons under the age of 18 to receive skill services from Skill Holders unless they are accompanied by you. You may not assign or otherwise transfer your Account to any other person or entity.

 

You agree to comply with all applicable laws when using the Services with Gigzeu or Services with Skill holders, and you may only use all the Services with Gigzeu or Skill holders for lawful purposes. You also agree to provide all necessary health, safety, environment arrangements and any others provisions applicable under the law while using the services provided by Skill Holder. You agree that you would treat the skill holder with respect and dignity. You also agree that there would no discrimination against the skill holder on the basis of colour, creed, race, cast, gender etc. You also agree that you would provide the all possible security to skill holders while working for you in your supervision. You will not, in your use of the Services with Gigzeu and Services with Skill holders, cause any kind of nuisance, annoyance, inconvenience, threat, insult, damage to property or reputation, harassment (e.g No PHYSICAL, EMOTIONAL, SOCIAL, SEXUAL OR ANY KIND OF HARRASMENT). In certain instances, you may be asked to provide proof of identity to access or use the Services by Gigzeu and Services provided by Skill Holders, and you agree that you may be denied access to or use of the Services if you refuse to provide proof of identity.

 

 

 

TEXT MESSAGING.

 

By creating an Account, you agree that the Services may send you informational text (SMS) messages as part of the normal business operation of your use of the Services. You may opt-out of receiving text (SMS) messages from Gigzeu at any time by sending an email to support@Gigzeu.com indicating that you no longer wish to receive such messages, along with the phone number of the mobile device receiving the messages. You acknowledge that opting out of receiving text (SMS) messages may impact your use of the Services.

 

PROMOTIONAL / DISCOUNT CODES.

 

Gigzeu may, in Gigzeus sole discretion, create promotional/discount codes that may be redeemed for Account credit, or other features or benefits related to the Services and/or a Skill holders services, subject to any additional terms that Gigzeu establishes on a per promotional /discount code basis (Promo/discount Codes). You agree that Promo/discount Codes: (i) must be used for the intended audience and purpose, and in a lawful manner; (ii) may not be duplicated, sold or transferred in any manner, or made available to the general public (whether posted to a public form or otherwise), unless expressly permitted by Gigzeu; (iii) may be disabled by Gigzeu at any time for any reason without liability to Gigzeu; (iv) may only be used pursuant to the specific terms that Gigzeu establishes for such Promo/discount Code; (v) are not valid for cash; and (vi) may expire prior to your use. Gigzeu reserves the right to withhold or deduct credits or other features or benefits obtained through the use of Promo/discount Codes by you or any other user in the event that Gigzeu determines or believes that the use or redemption of the Promo/discount Code was in error, fraudulent, illegal, or in violation of the applicable Promo/discount Code terms or these Terms.

 

USER PROVIDED CONTENT.

 

Gigzeur may, in Gigzeus sole discretion, permit you from time to time to submit, upload, publish or otherwise make available to Gigzeu through the Services textual, audio, and/or visual content and information, including commentary and feedback related to the Services, initiation of support requests, and submission of entries for competitions and promotions (User Content). Any User Content provided by you remains your property. However, by providing User Content to Gigzeu, you grant Gigzeu a worldwide, perpetual, irrevocable, transferrable, royalty-free license, with the right to sublicense, to use, copy, modify, create derivative works of, distribute, publicly display, publicly perform, and otherwise exploit in any manner such User Content in all formats and distribution channels now known or hereafter devised (including in connection with the Services and Gigzeus business and on third-party sites and services), without further notice to or consent from you, and without the requirement of payment to you or any other person or entity. You represent and warrant that: (i) you either are the sole and exclusive owner of all User Content or you have all rights, licenses, consents and releases necessary to grant Gigzeu the license to the User Content as set forth above; and (ii) neither the User Content nor your submission, uploading, publishing or otherwise making available of such User Content nor Gigzeus use of the User Content as permitted herein will infringe, misappropriate or violate a third partys intellectual property or proprietary rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation. You agree to not provide User Content that is defamatory, libelous, hateful, violent, obscene, pornographic, unlawful, or otherwise offensive, as determined by Gigzeu in its sole discretion, whether or not such material may be protected by law. Gigzeu may, but shall not be obligated to, review, monitor, or remove User Content, at Gigzeus sole discretion and at any time and for any reason, without notice to you.

 

NETWORK ACCESS AND DEVICES.

 

You are responsible for obtaining the data network access necessary to use the Services. Your mobile networks data and messaging rates and fees may apply if you access or use the Services from a wireless-enabled device and you shall be responsible for such rates and fees. You are responsible for acquiring and updating compatible hardware or devices necessary to access and use the Services and Applications and any updates thereto. Gigzeu does not guarantee that the Services, or any portion thereof, will function on any particular hardware or devices. In addition, the Services may be subject to malfunctions and delays inherent in the use of the Internet and electronic communications.

 

4. Payment

 

You understand that use of the Services may result in charges to you for the services or goods you receive from a Skill Holder (Charges ). After you have received services or goods obtained through your use of the Service, Gigzeu will facilitate your payment of the applicable Charges on behalf of the Skill Holder as such Skill holder limited payment collection agent. Payment of the Charges in such manner shall be considered the same as payment made directly by you to the Skill Holder. Charges will be inclusive of applicable taxes where required by law. Gigzeu reserves the right to charge you an additional amount for Surge/Safety etc. along with applicable taxes (including but not limited to GST). Charges paid by you are final and non-refundable, unless otherwise determined by Gigzeu. You retain the right to request lower Charges from a Skill Holder for services or goods received by you from such Skill Holder at the time you receive such services or goods. Gigzeu will respond accordingly to any request from a Skill Holder to modify the Charges for a particular service or good. All Charges are due immediately and payment will be facilitated by Gigzeu using the preferred payment method designated in your Account, after which Gigzeu will send you a receipt by email. If your primary Account payment method is determined to be expired, invalid or otherwise not able to be charged, you agree that Gigzeu may, as the Skill Holders limited payment collection agent, use a secondary payment method in your Account, if available. As between you and Gigzeu, Gigzeu reserves the right to establish, remove and/or revise Charges for any or all services or goods obtained through the use of the Services at any time in Gigzeus sole discretion. Further, you acknowledge and agree that Charges applicable in certain geographical areas may increase substantially during times of high demand. Gigzeu will use reasonable efforts to inform you of Charges that may apply, provided that you will be responsible for Charges incurred under your Account regardless of your awareness of such Charges or the amounts thereof. Gigzeu may from time to time provide certain users with promotional / Discount offers, subscriptions and discounts that may result in different amounts charged for the same or similar services or goods obtained through the use of the Services, and you agree that such promotional offers, subscriptions and discounts, unless also made available to you, shall have no bearing on your use of the Services or the Charges applied to you. You may elect to cancel your request for services or goods from a Skill Holder at any time prior to such Skill Holders arrival, in which case you may be charged a cancellation fee. This payment structure is intended to compensate working rate of the Skill Holder for the services provided. Except with respect to Skill Holder Services requested through the Application, Gigzeu does not designate any portion of your payment as a tip or gratuity or insurance regarding the work or material or any other statutory payment in regards to services to the Skill Holder. Any representation by Gigzeu (on Gigzeus website, in the Application, or in Gigzeus marketing materials) to the effect that tipping is voluntary, not required, and/or included in the payments you make for services or goods provided is not intended to suggest that Gigzeu provides any additional amounts, beyond those described above, to the Skill Holder. You understand and agree that, while you are free to provide additional payment as a gratuity/insurance/other legal obligation to any Skill holders who provides you with services or goods obtained through the Service. Gratuities are voluntary. After you have received services or goods obtained through the Service, you will have the opportunity to rate your experience and leave additional feedback about your Skill holder.

 

Insurance/Medical/Safety FEES.

 

You shall be responsible for the medical insurance / accidental insurance or any kind of safety related obligations in terms of money to skill holder resulting from use of the Services under your Account as per obligated by the law of the land (for eg. In handling of hazardous material, proper safety guidelines should be administered by you and medical insurance/accidental coverage or any other legal obligations should be provided by you).

 

5. Disclaimers; Limitation of Liability; Indemnity.

 

DISCLAIMER.

 

THE SERVICES ARE PROVIDED AS IS AND AS AVAILABLE. GIGZEU DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, NOT EXPRESSLY SET OUT IN THESE TERMS, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. IN ADDITION, GIGZEU MAKES NO REPRESENTATION, WARRANTY, OR GUARANTEE REGARDING THE RELIABILITY, TIMELINESS, QUALITY, SUITABILITY OR AVAILABILITY OF THE SERVICES OR ANY SERVICES OR GOODS REQUESTED THROUGH THE USE OF THE SERVICES, OR THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE. GIGZEU DOES NOT GUARANTEE THE QUALITY, SUITABILITY, SAFETY OR ABILITY OF SKILL HOLDERS. YOU AGREE THAT THE ENTIRE RISK ARISING OUT OF YOUR USE OF THE SERVICES, AND ANY SERVICE OR GOOD REQUESTED IN CONNECTION THEREWITH, REMAINS SOLELY WITH YOU, TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW.

 

LIMITATION OF LIABILITY.

 

GIGZEU SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST DATA, PERSONAL INJURY OR PROPERTY DAMAGE RELATED TO, IN CONNECTION WITH, OR OTHERWISE RESULTING FROM ANY USE OF THE SERVICES, EVEN IF GIGZEU HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. GIGZEU SHALL NOT BE LIABLE FOR ANY DAMAGES, LIABILITY OR LOSSES ARISING OUT OF: (i) YOUR USE OF OR RELIANCE ON THE SERVICES OR YOUR INABILITY TO ACCESS OR USE THE SERVICES; OR (ii) ANY TRANSACTION OR RELATIONSHIP BETWEEN YOU AND SKILL HOLDER, EVEN IF GIGZEU HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. GIGZEU SHALL NOT BE LIABLE FOR DELAY OR FAILURE IN PERFORMANCE RESULTING FROM CAUSES BEYOND GIGZEUS REASONABLE CONTROL. YOU ACKNOWLEDGE THAT SKILL HOLDERS PROVIDING SERVICES REQUESTED THROUGH SOME REQUEST MAY NOT BE PROFESSIONALLY LICENSED OR PERMITTED. IN NO EVENT SHALL GIGZEUS TOTAL LIABILITY TO YOU IN CONNECTION WITH THE SERVICES FOR ALL DAMAGES, LOSSES AND CAUSES OF ACTION EXCEED  ONE THOUSAND RUPEES (INR 1000). GIGZEUS SERVICES MAY BE USED BY YOU TO SEARCH THE DATABASE OF SKILL HOLDERS AND REQUEST AND SCHEDULE SKILL HOLDER SERVICES & GOODS WITH SKILL HOLDERS, BUT YOU AGREE THAT GIGZEU HAS NO RESPONSIBILITY OR LIABILITY TO YOU RELATED TO ANY SERVICES PROVIDED TO YOU BY THIRD SKILL HOLDERS OTHER THAN AS EXPRESSLY SET FORTH IN THESE TERMS. THE LIMITATIONS AND DISCLAIMER IN THIS SECTION 5 DO NOT PURPORT TO LIMIT LIABILITY OR ALTER YOUR RIGHTS AS A CONSUMER THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.

 

INDEMNITY.

 

You agree to indemnify and hold GIGZEU and its officers, directors, employees and agents harmless from any and all claims, demands, losses, liabilities, and expenses (including attorneys fees) arising out of or in connection with: (i) your use of the Services or services or goods obtained through your use of the Services; (ii) your breach or violation of any of these Terms; (iii) Gigzeus use of your User Content; or (iv) your violation of the rights of any third party, including Skill holders.

 

6. Governing Law; Arbitration.

 

Except as otherwise set forth in these Terms, these Terms shall be exclusively governed by and construed in accordance with the laws of India. Any dispute, conflict, claim or controversy arising out of or broadly in connection with or relating to the Services or these Terms, including those relating to its validity, its construction or its enforceability (any Dispute) shall be first mandatorily submitted to mediation proceedings in terms of the Indian law. If such Dispute has not been settled within sixty (60) days after a request for mediation has been submitted under the Indian laws, such Dispute can be referred to and shall be exclusively and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996 (Act). The Dispute shall be resolved by one (1) arbitrator to be appointed in accordance with the Act. The place of both mediation and arbitration shall be India. The language of the mediation and/or arbitration shall be English, unless you do not speak English, in which case the mediation and/or arbitration shall be conducted in both English and your native language. The existence and content of the mediation and arbitration proceedings, including documents and briefs submitted by the parties, any correspondence from the mediator, and correspondence, orders and awards issued by the sole arbitrator, shall remain strictly confidential and shall not be disclosed to any third party without the express written consent from the other party unless: (i) the disclosure to the third party is reasonably required in the context of conducting the mediation or arbitration proceedings; and (ii) the third party agrees unconditionally in writing to be bound by the confidentiality obligation stipulated herein.

 

GIGZEU GUIDELINES FOR LAW ENFORCEMENT AUTHORITIES

 

The following guidelines are intended to inform law enforcement about the legal process for seeking records from Gigzeu. These are merely guidelines, and this information may change at any time. For private party requests, including requests from civil litigants and criminal defendants, we recommend browsing Guidelines for Third Party Data Requests.

 

WHAT IS GIGZEU AND WHAT RECORDS DO WE HAVE?

 

Gigzeu is a technology company that has developed an app that connects users with skill holder who provide gig economy / skill-based services to the user. Gigzeu has nothing to do with services or work related to skill holders , and does not employ any Skill Holders. Users can use the Gigzeu App to request skill services via their smartphone, the web, or via SMS. Gigzeu users can choose from a variety of Skill holder available in his or her location. At the end of the services, both the skill holder and user receive a copy of the payment receipt. More information about our services is available on our website. We store and maintain information as described in our Privacy Statements and our Terms of Use.

 

WHAT TYPE OF LEGAL PROCESS DOES GIGZEU REQUIRE BEFORE PRODUCING USER OR PARTNER INFORMATION?

 

We require valid and sufficient legal process before we can disclose business records regarding partners, users, or orders. In most instances, we wont be able to provide any information without a valid subpoena, court order, or search warrant. We accept law enforcement requests via email to Legal@Gigzeu.com. Our acceptance of legal process does not waive any legal objections Gigzeu may have and may raise in response to the request.

 

WHAT FORM OF REQUESTS DOES GIGZEU REQUIRE, AND HOW ARE REQUESTS PROCESSED?

 

To respond to a request, we will need to receive the applicable process described above, as well as a valid return email address from an official government domain. We review each request for facial and substantive validity, and will reject requests that are not facially and substantively valid. Among other things, we require requests to be narrowly tailored to a legitimate law enforcement need and will reject overly broad, vague, or unduly burdensome requests. In order to make sure your Law Enforcement Request is valid and does not seek more information than necessary, we ask for the following: A sufficiently narrow/defined time period; A specific event or action that the subject took; A specific reference (i.e., you must uniquely identify a user or Skill holder) We disclose data to law enforcement when we determine that we are required to do so by law. In those instances, we will search for and disclose data that we are reasonably able to locate and retrieve.

 

HOW DOES GIGZEU HANDLE EMERGENCY REQUESTS?

 

We have a process for evaluating requests on an emergency basis where there is an emergency that involves protecting a user, Skill holder, or third party or stopping illegal activity that poses an immediate threat of death or serious bodily harm. We have an emergency button on our app for Skill holder and customer. Our Emergency team will reach on you registered mobile number. No Response in 60 mins would escalate the matter to local Police. Requestors may also submit an Emergency Request Form (which can be requested through Legal@Gigzeu.com) that describes in detail the nature of the emergency, and we review these requests on a case-by-case basis. Law enforcement can submit an emergency request by emailing Legal@Gigzeu.com. Please note that we will only review and respond to emergency requests from law enforcement, and will not respond to emergency requests sent to this address by non-law enforcement officials. Non-law enforcement officials aware of an emergency situation should immediately and directly contact local law enforcement officials.

 

DOES GIGZEU NOTIFY INDIVIDUALS OF A LAW ENFORCEMENT REQUEST FOR INFORMATION RELATING TO THEM?

 

Yes, we may notify subjects before producing their information to law enforcement, unless we are prohibited by law from doing so, or in exceptional circumstances such as emergencies. Law enforcement officials who believe that notification would jeopardize an investigation should obtain an appropriate court order or other appropriate process establishing that notice is prohibited.

 

DOES GIGZEU PROVIDE A CERTIFICATE OF AUTHENTICATION OR EXPERT TESTIMONY?

 

We may provide a certification from our records / Database only custodian but are not generally able to provide in-person or expert witness testimony. Law enforcement officials with questions about these guidelines should email Legal@Gigzeu.com. Please note that we will not respond to non-law enforcement inquiries received at this email address.

 

Terms & Conditions specific for booking less than 12 or 12 hrs (contract)

1.     By booking a domestic help/cook/skill holder/helper through Gigzeu, the customer is entering into an agreement with the Gigzeu, on 30 days basis validity from the date of start of the service.

2.     The salary of the helper/skill holder will be routed through Gigzeu (Mobile application) where will raise an invoice and the client would be required to pay through the above mentioned official payment channels of the company only. Gigzeu will not be responsible for any amount paid to the helper directly without inform to company.

3.     Gigzeu will provide trained/semi trained/untrained helpers as requested by customer. However, Gigzeu is/will not be liable for any untoward incidents like theft, illegal activities, damages, etc. Gigzeu will assist in filing a police complaint if the situation requires such a step in addition to blacklisting the helper from its database.

4.     By agreeing to these terms of use, the client agrees to behave in an appropriate manner and not torture the helper mentally or physically in any way.

5.     Client are advised not to provide any advance/loan etc. directly to helper/skill holder. Client should take prior written consent of Gigzeu to give any money to skill holder. Gigzeu will not responsible for any loss due to advances/loan to client.

6.     Client are advised not to provide your contact number to helper/skill holder. Client can contact skill holder via gigzeu app call masking solution to keep his/her phone number confidential. Gigzeu will not responsible for any kind of loss or nuisance due to sharing of contact details with skill holders.

7.     The helper has the right to get fresh and timely meals, a clean and hygienic place to rest and defecate etc.

8.     The client cannot reduce the helper's salary for the same work agreement. If such a case happens, Gigzeu has the right to withdraw their services and stop the helper from executing the services.

9.     The client cannot ask the helper to execute services other than the ones helper has been booked for as per the scope of work in the online communication. If the helper is asked to do additional work, it is up to the helper to agree to such work, at a cost additional to the existing pay that the client shall be liable to pay.

10.  Introductions are strictly confidential. If Gigzeu introduces a candidate that the client then introduces to a third party, who hires the candidate on either full time or part time basis, the new client agrees to pay Gigzeu the applicable charges and the former agreement with the original customer stands cancelled.

11.  The salary of the helper will be in INR per 30 days with standard working hours per day, during the period of agreement. (hours and salary to be decided by client at the time of selection of helper)

12.  The salary of the helper will have to be paid in full for the number of days worked. The decided salary cannot be reduced at any point of time due to any reason. A day would be counted as a working day even if the helper has worked for an hour on the specified day, even if it happens to be the day of termination of the helper’s services.

13.  Gigzeu has the right to ask the client for their and their family members’ RTPCR reports, to ensure helper's safety also.

14.  Gigzeu has the right to ask the client for their ID and address proof to ensure helper and company’s safety.

15.  General sickness, ongoing viral, flu etc. contracted during employment is under the scope of the client and Gigzeu will not be liable to arrange for additional tests or transportation for the same.

16.  Client will settle the salary of helper along with convenience fees within 2 working days of generation of invoice.

17.  Client undertakes that he will not allure/entice helper/skill holder to disengage with Gigzeu.

18.  Client will give notice period of 7 working days in case of earlier termination of contract or renewal of 30 days contract.

19.  Client needs to put the grievance against skill holder/helper on mobile application. Gigzeu will appoint a representative to resolve grievance. Gigzeu has two layer Grievance redressal mechanism.

a)    The representative will take cognizance of any grievance & talk and counsel the skill holder.

b)    The representative will have conference call or in person meeting with skill holder & client to reach a common understanding.

c)     In case of upskilling of skill holder, a 3 days on the job training may be provided by Gigzeu representative with approval of client.

Charges and Temporary Replacement Policy on Minimum Work Requirement

These are the terms of use for refund and replacement for DOMESTIC HELP/ COOK/ CHEF/ BABYSITTER/ OLD AGE HELPER or any other services availed from Gigzeu.

1.       Gigzeu will charging 20% as convenience fees over the earned salary of the person

2.       Gigzeu will send a temporary replacement according to minimum work requirement in the event of unapproved leave or absenteeism by assigned skill holder. Customer needs to pay for the minimum work amount for that day or on full work done by temporary replacement at the rate of his/regular skill holder/domestic help.

3.       Temporary replacement will be provided at the request of customer at least 2 hours prior to the commencement of work.

4.       Temporary replacement will be sent as per availability and at discretion of Gigzeu.

5.       Customer shall give OTP to Domestic helper/Skill holder at the time of starting work. In case, customer doesn’t provide the OTP then full day attendance will be taken of skill holder unless it is duly informed by customer to Gigzeu representative.

6.       All solicitations are subjected to Delhi Jurisdiction only.

7.       The last right to terminate a contract without any compensation lies with Gigzeu.

 

Terms & Conditions for 24 hrs / living in contract booking

1.     By booking a domestic help/cook/skill holder/helper through Gigzeu, the customer is entering into an agreement with the Gigzeu, on 30 days basis validity from the date of start of the service.

2.     The salary of the helper/skill holder will be routed through Gigzeu (Mobile application) where will raise an invoice and the client would be required to pay through the above mentioned official payment channels of the company only. Gigzeu will not be responsible for any amount paid to the helper directly without inform to company.

3.     Gigzeu will provide trained/semi trained/untrained helpers as requested by customer. However, Gigzeu is/will not be liable for any untoward incidents like theft, illegal activities, damages, etc. Gigzeu will assist in filing a police complaint if the situation requires such a step in addition to blacklisting the helper from its database.

4.     By agreeing to these terms of use, the client agrees to behave in an appropriate manner and not torture the helper mentally or physically in any way.

5.     Client are advised not to provide any advance/loan etc. directly to helper/skill holder. Client should take prior written consent of Gigzeu to give any money to skill holder. Gigzeu will not responsible for any loss due to advances/loan to client.

6.     Client are advised not to provide your contact number to helper/skill holder. Client can contact skill holder via gigzeu app call masking solution to keep his/her phone number confidential. Gigzeu will not responsible for any kind of loss or nuisance due to sharing of contact details with skill holders.

7.     The helper has the right to get fresh and timely meals, a clean and hygienic place to sleep, bathe and defecate etc.

8.     The client cannot reduce the helper's salary for the same work agreement. If such a case happens, Gigzeu has the right to withdraw their services and stop the helper from executing the services.

1.       Gigzeu will charging 20% as convenience fees over the earned salary of the person.

2.       Gigzeu will take one time refundable security of Rs 5000 from client. Rs 5000 will be adjusted with dues at the end of service or earlier termination of contract. However, Rs 5000 will not be refunded in case of breach of terms & conditions.

3.       However, Replacement will be given to the customer subject to availability of profiles & the following issues faced by them, only in case the helper provided by Gigzeu:

a.     is unwilling to work 

b.     has medical conditions which cause an issue with the work or could be a concern for the client or their family members

c.     Gross misconduct like stealing, harassing client, manhandling, misbehaving.

4.       Replacements will be provided at no additional charges.

5.       Refund will be provided ONLY if Gigzeu is not able to find a replacement after release of the last helper supplied by Gigzeu, for the same scope of work and hours as decided earlier.

6.       No replacement or refund would be provided if:

A.    The helper at any point of time during the period of service is mistreated or abused, either mentally or physically or is made to work for more than 10 hrs a day against their will

B.    The customer decides to relocate outside of Delhi-NCR, or if the client tries to relocate the helper to any other accommodation (even within Delhi NCR) without informing Gigzeu.

C.    The helper or Gigzeu is not logically at fault and it’s only the customer’s wish to cancel the agreement. 

D.    The helper wants to discontinue the work (for any reason) and leave the client’s premises, of which the client has been informed by Gigzeu, and the client is holding on to him/her against their will.

E.     There has been a change in scope of work or the salary of the helper without intimation or approval of Gigzeu.

F.     In case of replacement, the salary of the replacement profile cannot be lower than the salary decided for the previous helper supplied by Gigzeu.

7.       All solicitations are subjected to Delhi Jurisdiction only.

We may ask you to provide us with certain Protected Information. We may collect this information through various means and in various places through the Services, including account registration forms, contact us forms, or when you otherwise interact with us. The skill holders mobile phone will send your GPS coordinates, during the work, to our servers. Most GPS enabled mobile devices can define ones location to within 50 feet.

 

▪ Usage Information may be collected using a cookie. If you do not want information to be collected through the use of cookies, your browser allows you to deny or accept the use of cookies. Cookies can be disabled or controlled by setting a preference within your web browser or on your Device.

 

If you choose to disable cookies or flash cookies on your Device, some features of the Services may not function properly or may not be able to customize the delivery of information to you. The Company cannot control the use of cookies (or the resulting information) by third parties, and use of third party cookies is not covered by our Privacy Policy.

3. USE OF INFORMATION COLLECTED

 

o Our primary goal in collecting your information is to provide you with an enhanced experience when using the Services. We use your information to closely monitor which features of the Services are used most, to allow you to view your Work history, rate work / skill holders, and to determine which features we need to focus on improving, including usage patterns and geographic locations to determine where we should offer or focus services, features and/or resources.

 

o Based upon the Protected Information you provide us when registering for an account, we will send you a welcoming email to verify your username and password.

 

o We use the information collected from our Mobile Application so that we are able to serve you the correct app version depending on your device type, for troubleshooting and in some cases, marketing purposes.

 

o We use your Internet Protocol (IP) address to help diagnose problems with our computer server, and to administer our web site(s). Your IP address is used to help identify you, but contains no personal information about you.

 

o We will send you strictly service-related announcements on rare occasions when it is necessary to do so. For instance, if our Services are temporarily suspended for maintenance, we might send you an email. If you do not wish to receive them, you have the option to deactivate your account.

 

o We may use the information obtained from you to prevent, discover and investigate violations of this Privacy Policy or any applicable terms of service or terms of use for the Mobile Application, and to investigate fraud, chargeback or other matters.

 

o We provide some of your Protected Information (such as your name, address, contact number) to the skill holders who accepts your request for work so that the skill holder may contact and find you.

 

o We use that geo-location information for various purposes, including for you to be able to view the skill holders in your area that are close to your location, for you to set your pick up location, for the skill holders to identify the location, to send you promotions and offers, and to allow you (if you choose through any features we may provide) to share this information with other people.

 

o In addition, we may use your Protected Information or Usage Information that we collect about you: (1) to provide you with information or services or process transactions that you have requested or agreed to receive including to send you electronic newsletters, or to provide you with special

 

offers or promotional materials on behalf of us or third parties; (2) to enable you to participate in a variety of the Services features such as online or mobile entry sweepstakes, contests or other promotions; (3) to contact you with regard to your use of the Services and, in our discretion, changes to the Services and/or the Services policies; (4) for internal business purposes; (5) for inclusion in our data analytics; and (6) for purposes disclosed at the time you provide your information or as otherwise set forth in this Privacy Policy.

 

o We may use the information collected from you for targeted advertising. This involves using information collected on an individual's web or mobile browsing behavior such as the pages they have visited or the searches they have made. We use third party companies and individuals to facilitate our Services, provide or perform certain aspects of the Services on our behalf – such as skill holder they work for to provide the Services, other third parties to host the Services, design and/or operate the Services features, track the Services analytics, process payments, engage in anti-fraud and security measures, provide customer support, provide geo-location information to our skill holders, enable us to send you special offers, host our job application form, perform technical services (e.g., without limitation, maintenance services, database management, web analytics and improvement of the Services‘ features), or perform other administrative services. These third parties will have access to user information, including Protected Information to only carry out the services they are performing for you or for us. Each of these third parties are required to ensure the same level of data protection as us and are obligated not to disclose or use Protected Information for any other purpose. Analytics may set and access their own cookies, web beacons and embedded scripts on your Device and they may otherwise collect or have access to information about you, including non-personally identifiable information. We use a third party hosting provider who hosts our support section of our website. Information collected within this section of our website by such third party is governed by our Privacy Policy.

(c) CO-BRANDED SERVICES.

 

Certain aspects of the Services may be provided to you in association with third parties (Co-Branded Services”) such as sponsors and charities, and may require you to disclose Protected Information to them. Such Co-Branded Services will identify the third party. If you elect to register for products and/or services through the Co-Branded Services, you shall have deemed to consent to providing your information to both us and the third party. Further, if you sign-in to a Co-Branded Service with a username and password obtained through our Services, your Protected Information may be disclosed to the identified third parties for that Co-Branded Service and will be subject to their posted privacy policies.

 

(d) CONTESTS AND PROMOTIONS

 

We may offer Promotions through the Services that may require registration. By participating in a Promotion, you are agreeing to official rules that govern that Promotion, which may contain specific requirements of you, including, allowing the sponsor of the Promotion to use your name, voice and/or likeness in advertising or marketing associated with the Promotion. If you choose to enter a Promotion, you agree that your Protected Information may be disclosed to third parties or the public in connection with the administration of such Promotion, including, in connection with winner selection, prize fulfillment, and as required by law or permitted by the Promotions official rules, such as on a winners list.

 

(e) ADMINISTRATIVE AND LEGAL REASONS

 

We cooperate with Government and law enforcement officials and private parties to enforce and comply with the law. Thus, we may access, use, preserve, transfer and disclose your information (including Protected Information, IP address, Device Information or geo-location data), to Government or law enforcement officials or private parties as we reasonably determine is necessary and appropriate: (i) to satisfy any applicable law, regulation, subpoenas, Governmental requests or legal process; (ii) to protect and/or defend the Terms and Conditions for online and mobile Services or other policies applicable to any online and mobile Services, including investigation of potential violations thereof; (iii) to protect the safety, rights, property or security of the Company, our Services or any third party; (iv) to protect the safety of the public for any reason; (v) to detect, prevent or otherwise address fraud, security or technical issues; and /or (vi) to prevent or stop activity we may consider to be, or to pose a risk of being, an illegal, unethical, or legally actionable activity.

 

(f) WHEN YOU SHARE INFORMATION

 

Protected Information may be collected and shared with third-parties if there is content from the Mobile Application that you specifically and knowingly upload to, share with or transmit to an email recipient, online community, website, or to the public, e.g. uploaded photos, posted reviews or comments, or information about you or your ride that you choose to share with others through features which may be provided on our Services. This uploaded, shared or transmitted content will also be subject to the privacy policy of the email, online community website, social media or other platform to which you upload, share or transmit the content.

 

(g) BUSINESS TRANSFER

 

We may share your information, including your Protected Information and Usage Information with our parent, subsidiaries and affiliates for internal reasons, including business and operational purposes. We also reserve the right to disclose and transfer all such information: (i) to a subsequent owner, co-owner or operator of the Services or applicable database; or (ii) in connection with a corporate merger, consolidation, restructuring, the sale of substantially all of our membership interests and/or assets or other corporate change, including, during the course of any due diligence process.

 

(h) MARKET STUDY AND OTHER BENEFITS

(i) WITH THE OWNER OF GiGZEU ACCOUNTS THAT YOU MAY USE

 

If you use an account or profile associated with another party we may share the details of the work with the owner of the profile. This may occur:

 

A. If you use your employers profile under a corporate arrangement;

 

B. If you take work arranged by a friend.

 

5. THIRD PARTY CONTENT AND LINKS TO THIRD PARTY SERVICES

 

The Services may contain content that is supplied by a third party, and those third parties may collect website usage information and your Device Identifier when web pages from any online or mobile Services are served to your browser. In addition, when you are using the Services, you may be directed to other sites or applications that are operated and controlled by third parties that we do not control. We are not responsible for the privacy practices employed by any of these third parties. For example, if you click on a banner advertisement, the click may take you away from one of our websites onto a different web site. These other web sites may send their own cookies to you, independently collect data or solicit Protected Information and may or may not have their own published privacy policies. We encourage you to note when you leave our Services and to read the privacy statements of all third party web sites or applications before submitting any Protected Information to third parties.

 

 

 

6. SOCIAL MEDIA FEATURES AND WIDGETS

 

Our online and mobile Services may include social media features, such as the Facebook Like button, and widgets such as a Share This” button, or interactive mini-programs that run on our online and mobile Services. These features may collect your IP address, photograph, which page you are visiting on our online or mobile Services, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on our online Services. Your interactions with these features and widgets are governed by the privacy policy of the company providing them.

 

7. INFORMATION COLLECTED BY Skill Holders

 

This Privacy Policy shall not cover the usage of any information about you which is obtained by the skill holder or the company to which the skill holder belongs, while providing you a ride on a cab booked using the Services, or otherwise, which is not provided by us.

 

8. CHANGE OF INFORMATION AND CANCELLATION OF ACCOUNT

 

(a) You are responsible for maintaining the accuracy of the information you submit to us, such as your contact information provided as part of account registration. If your Protected Information changes, or if you no longer desire our Services, you may correct, delete inaccuracies, or amend information by making the change on our member information page or by contacting us through email address mentioned on our website or Mobile Application. We will make good faith efforts to make requested changes in our then active databases as soon as reasonably practicable.

 

(b) You may also cancel or modify your communications that you have elected to receive from the Services by following the instructions contained within an e-mail or by logging into your user account and changing your communication preferences.

 

(c) If upon modifying or changing the information earlier provided to Us, we find it difficult to permit access to our Services to you due to insufficiency/ inaccuracy of the information, we may, in our sole discretion terminate your access to the Services by providing you a written notice to this effect on your registered email id.

 

(d) If you wish to cancel your account or request that we no longer use your information to provide you services, contact us through email address mentioned on the trip bill received.
